I. CLUB 360° Membership Program Terms and Conditions
(Adopted on and effective from 25 October 2022)
The CLUB 360° membership program (“CLUB 360°”) is operated by CIAO International Limited and Best Mart 360 Macau Limited (“we”, “us”, “our”) in Best Mart 360° and FoodVille retail outlets in Hong Kong and Macau. All members of CLUB 360° physical membership card (“physical membership card”) and / or the electronic membership card (“E-card”) in the Best Mart 360 Mobile Application (“Mobile App”) or WeChat Mini Program (“WeChat Mini Program”, both named as The CLUB 360° membership program) (both “physical membership card” and “E-card” are jointly defined as “Membership Card”) must agree to fully comply with the Terms and Conditions of CLUB 360°. By submitting a CLUB 360° membership registration application or otherwise becoming or has become a member of CLUB 360°, the applicant acknowledges that he/she has read, understood and agreed to accept and be bound by the following Terms and Conditions.
1. Membership Application
1.1. To become a member of CLUB 360°:
(A) an applicant who has made a purchase of HKD200/MOP200 or above in one single transaction in either our Hong Kong or Macau retail outlets may, by using the “Invitation Code” printed on the receipt, sign up and register as an “Member” through the E-card downloaded and installed in the applicant’s smart mobile phone. Such transaction only entitles an applicant to be qualified for registration as a member only and carries no membership privileges.; OR
(B) an applicant may download the E-card and register as a “Fans” member for free through the E-card downloaded and installed in the applicant’s smart mobile phone.
1.2. Each “Invitation Code” is valid for 60 days from the date of issue (including the issue date).
1.3. (A) Existing member(s) holding a physical membership card who intends to use the E-card may obtain from our frontline staffs a free registration invoice (which is valid for [60] days from the date of issue, inclusive of the issue date) by presenting his/her physical membership card, and register on the E-card:
(i) Mobile App Registration Flow: Existing member(s) holding a physical membership card who intends to use the E-card will need to register through the Best Mart 360 Mobile App downloaded and installed in his/her smart mobile phone, such member should select “First time login for APP & Physical Card Member” in the interface of “Member Zone”, and then select “Physical Card (Not yet registered in APP before)”. Afterwards, by inputting the Physical Card Number (Card Back ID), Invoice Number and Store Code as shown on the registration invoice, and then inputting simple personal information and setting password, such member will be able to use the E-card.
(ii) WeChat Mini Program Registration Flow: Existing member(s) holding a physical membership card who intends to use the E-card will need to register through the WeChat Mini Program, such member should select “Member Login”, and then select “Physical Card (Not yet registered in APP before)”. Afterwards, by inputting the Physical Card Number (Card Back ID), Invoice Number and Store Code as shown on the registration invoice, and then inputting simple personal information and setting password, such member will be able to use the E-card through the WeChat Mini Program.
(B) Existing member(s) holding the E-card (version 1.0)(i.e. members who have registered as a E- card member before 17 June 2020) who intends to use the E-card will need to register through the Mobile App or WeChat Mini Program downloaded and installed in his/her smart mobile phone.
(i) Mobile App Registration Flow: Existing E-card members (version 1.0) should download the Best Mart 360 Mobile App and select “First time login for APP & Physical Card Member” in the interface of “Member Zone”, and then select “E- card (Mobile App )(Physical Card registered in APP before)”, then inputting the correct and previously registered email address or mobile phone number so as to receive and input a one-time code for verification. After inputting certain simple personal information and setting password, such member will be able to use the E-card .
(ii) WeChat Mini Program Registration Flow: Existing E-card members (version 1.0) may select “Existing Member Log in” on the WeChat Mini Program main page, and then select “E-card (APP) (Including APP 1.0 and 2.0 members) in the interface of “Member Login”, and then inputting the correct and previously registered email address or mobile phone number as to receive and input a one-time code for verification. After inputting certain simple personal information, such member will be able to use the E-card.
(C) Member(s) who intends to use the Mobile App together with the WeChat Mini Program at the same time may select “Member Login” on the WeChat Mini Program main page, and then select “E-card (APP) (Including APP 1.0 and 2.0 members) in the interface of “Member Login”. After inputting the previously registered email address or mobile phone number and password, such member will be able to use the E-card.
(D) Member(s) who intends to use the WeChat Mini Program together with the Mobile App at the same time may select “First time Login for WeChat Mini Program member” in the interface of “Member Zone” and input the correct and previously registered mobile phone number to receive and input a one-time code for verification. After inputting certain simple personal information and setting password, such member will be able to use the E-card.
1.4. All applicants must be 18 years old or above. We reserve all of the rights to grant or refuse CLUB 360° Membership at our sole discretion.
1.5. All applicants applying for CLUB 360° membership registration must fill in and provide us with his/her name, gender, mobile phone number, email address and month of birth (hereinafter referred to as “ Relevant Information”). The applicant must ensure that all Relevant Information provided is true, accurate and complete. If the applicant is unable or unwilling to provide true, correct and complete Relevant Information, we have the rights to refuse such membership application and/or refuse to provide membership services to such person. To the extent permitted by law, we shall not be liable for any loss, damage, claim, demand, liability or action resulting from the applicant or the member's omission, negligence and/or failure to supply us with the Relevant Information and/or his/her latest Relevant Information, or arising from the truthfulness, the accuracy and the completeness of those information.
1.6. Each CLUB 360° member is only eligible to maintain ONE CLUB 360° membership number and membership. Each email address and phone number registered can only be associated with one membership. If we find/or suspect that any member has more than one membership account in our system, we have the rights to terminate the relevant accounts and suspend their usage, without any prior notice and compensation.
1.7. Best Mart 360 Mobile Application supports devices with (A) IOS11.0 or above; and (B) Android 7.0 or above.
2. Membership Tiers and Validity
2.1 CLUB 360° membership is divided into three tiers, i.e. "Fans", "Members” (including E-card and physical membership card members) and "Gold Card Members" (hereinafter referred to as "All Members"). The membership tier and validity period of the membership are determined according to the accumulated spending amount of the respective member category during specific period. A member is bound by the Terms and Conditions and membership privileges applicable to the tier and category of his/her membership.
(A) “Fans” membership and upgrade conditions:
(i) After registering as “Fans” members in accordance with paragraph 1.1(B) above, members can enjoy welcome privileges.
(ii) “Fans” members who have accumulated spending of an aggregate of HKD 300 or MOP 300 through the E-card within 60 consecutive days from the date of registration of the E-card ("Membership Effective Date") (inclusive of the Membership Effective Date), or who have spent HK 200 / MOP 200 or above in one single transaction through the E-card at Best Mart 360° or FoodVille retail outlets in Hong Kong or Macau, can be upgraded to the tier of “Members” and enjoy relevant benefits of “Members”. For members who are unable to upgrade to the tier of “Members” within the prescribed period, calculation of the accumulative spending period will restart for 60 consecutive days period (inclusive of purchases made on that date) after the expiration of prescribed period.
(iii) Unless otherwise offered in our promotion activities, the accumulated spending of “Fans” members during the “Fans” validity period will only be used for calculation of upgrade conditions. No member privileges can be enjoyed (including but not limited to member price, member points reward, member points redemption, member day double reward points, birthday benefits and E-stamp promotion).
(B) “Member” membership and upgrade conditions:
E-card holders:
(i) After registering as “Member” in accordance with paragraph 1.1(A) above, members can enjoy welcome privileges and members’ privileges commencing from the next purchase.
(ii) Members who have accumulated an aggregate spending of HKD 2,500 or MOP 2,500 through the E-card at Best Mart 360 ° or FoodVille retail outlets in Hong Kong or in Macau within 365 consecutive days from the date of registration of the E-card in accordance with paragraph 1.1(A) above or from the date of registering the use of the E-card in accordance with paragraph 1.3(A) or (B) above (“Membership Effective Date")(inclusive of the Membership Effective Date) can be upgraded to “Gold Card Members” and enjoy relevant benefits of “Gold Card Members”.
(iii) If a member does not accumulate spending of an aggregate of HKD 2,500 or MOP 2,500 within 365 consecutive days from the Membership Effective Date (inclusive of the Membership Effective Date), his/her membership tier will be maintained, and he/she will continue to enjoy relevant benefits of “Member”. The accumulated spending amount will be reset to “0” on the next day of the anniversary of the Membership Effective Date, and accumulation of spending amount will restart for 365 consecutive days period (inclusive of purchases made on that date).
Physical membership card holders/E-card (version 1.0) holders
(i) Existing physical membership card holders must complete registration as a E-card member in accordance with the renewal registration procedures as stated in Notes (1) and (2) below, in order to enjoy privileges applicable to CLUB 360° Members (E-card holders). If a physical membership card holder does not renew registration in accordance the aforesaid procedures, such member will continue to enjoy privileges applicable to Members (physical membership card holders).
(ii) A member holding the E-card (version 1.0) must renew his/her registration as a E-card member in accordance with Note (3) below, in order to enjoy privileges applicable to CLUB 360° Members (E-card holders). If a member holding the E-card (version 1.0) does not renew registration in accordance with the aforesaid procedures, such member will not continue to enjoy privileges applicable to Members (E-card version 1.0 cardholders).
(C) “Gold Card” membership and upgrade conditions
(i) Gold Card Members who have accumulated an aggregate spending of HKD 2,500 or MOP 2,500 at Best Mart 360° or FoodVille retail outlets in Hong Kong or Macau within 365 consecutive days from the date of upgrade from “Member” to “Gold Card Member” (hereinafter referred to “Gold Card Membership Effective Date”) (inclusive of the Gold Card Membership Effective Date), can extend the “Gold Card” membership for 1 year (hereinafter referred to “Gold Card Membership Extension Date”) and continue to enjoy the privileges applicable to “Gold Card” members. The “Gold Card” membership can be renewed not more than once in each calendar year.
(ii) If a Gold Card Member does not accumulate an aggregate spending of HKD 2,500 or MOP 2,500 within 365 consecutive days from the Gold Card Membership Effective Date or the latest Gold Card Membership Extension Date, his/her membership will be downgraded to “Member” on the next day of the anniversary of the Gold Card Membership Effective Date or the latest Gold Card Membership Extension Date and shall only enjoy the relevant benefits of Member. The accumulated spending amount will be reset to “0” on the next day of the anniversary of the Gold Membership Effective Date or the latest Gold Card Membership Extension Date. The accumulation of spending amount will be restarted and counted as “Member” to accumulate spending of an aggregate of HKD 2,500 or MOP 2,500 within 365 consecutive days (inclusive of purchases made on that date).
Notes: (1) Existing physical membership card holders and E-card holders (version 1.0) (i.e. members registered before 17 June 2020) are updated as “Members” in CLUB 360° membership program, such members must re-register for the use of the E-card through the Mobile App or WeChat Mini Program in order to enjoy all privileges applicable to “Members” (E-card holders).
(2) Existing physical membership card holder who intends to use the E-card may obtain from our frontline staffs a free registration invoice (which is valid for 60 days from the date of issue, inclusive of the issue date) by presenting his/her physical membership card and register through the Mobile App or WeChat Mini Program:
(i) Mobile App Registration Flow: Existing member(s) holding a physical membership card who intends to use the E-card will need to register through the Mobile App downloaded and installed in his/her smart mobile phone, such member should select “First time login for APP & Physical Card Member” in the interface of “Member Zone”, and then select “Physical Card (Not yet registered in APP before)”. Afterwards, by inputting the Physical Card Number (Card Back ID), Invoice Number and Store Code as shown on the registration invoice, and then inputting simple personal information and setting password, such member will be able to use the E-card . However, certain functions (including but not limited to birthday benefits, E-coupon and E-stamp promotion) can only be collected and redeemed in the E-card.
(ii) WeChat Mini Program Registration Flow: Existing member(s) holding a physical membership card who intends to use the E-card will need to register through the WeChat Mini Program, such member should select “Member Login”, and then select “Physical Card (Not yet registered in APP before)”. Afterwards, by inputting the Physical Card Number (Card Back ID), Invoice Number and Store Code as shown on the registration invoice, and then inputting simple personal information, such member will be able to use the E-card.
(3) Existing members holding the E-card (version 1.0) (i.e. members who have registered as a E-card member before 17 June 2020) who intends to use the E-card through the Mobile App or WeChat Mini Program will need to register through the Mobile App or WeChat Mini Program downloaded and installed in his/her smart mobile phone:
(i) Mobile App Registration Flow: Existing E-card members (version 1.0) should download the Best Mart 360 Mobile App and select “First time login for APP & Physical Card Member” in the interface of “Member Zone”, and then select “E-card (Mobile App)(Physical Card registered in APP before)”, then inputting the correct and previously registered email address or mobile phone number so as to receive and input a one-time code for verification. After inputting certain simple personal information and setting password, such member will be able to use the E-card .
(ii) WeChat Mini Program Registration Flow: Existing members holding the E-card (version 1.0) may select “Existing Member Log in” on the WeChat Mini Program main page, and then select “E-card (APP) (Including APP 1.0 and 2.0 members) in the interface of “Member Login”, and then inputting the correct and previously registered email address or mobile phone number as to receive and input a one-time code for verification. After inputting certain simple personal information, such member will be able to use the E-card.
2.2 All Members must register and sign up for the E-card in order to accumulate the spending amount for upgrading to the next tier of membership. The spending of existing physical membership card members and E-card (version 1.0) members who have not yet registered for the E-card will not be counted for membership upgrade purpose.
2.3 The spending amount accumulated during the validity period by a E-card member will be accounted for on the next day after the day of completion of the transaction, and the adjustment for upgrade/downgrade/continuation of membership tier (if any) will be completed on the same date; such date will also be regarded as the membership effective date for the new membership tier. In order to accumulate spending amount for upgrade calculation, the E-card must be presented before payment.
2.4 Designated member benefits (including but not limited to welcome privileges, birthday benefits, E-coupon and E-stamp) must be accumulated / collected / redeemed through the Mobile App or through the WeChat Mini Program, apart from E-Stamp.
2.5 Certain benefits (such as welcome privileges, birthday benefits, E-coupon) enjoyed or collected by each membership tier will be distributed according to the region selected (i.e. Hong Kong or Macau) at the initialization of the E-card. Once the region is selected, no changes can be made. If a member uses the Mobile App and the WeChat Mini Program at the same time, they will be regarded as the same membership without enjoying double benefits. When a member uses the discount on the Mobile App or the WeChat Mini Program, the corresponding benefits on the other platform will be automatically deducted.
3. Member’s Privileges
3.1 Once successfully signed up and registered as a member, such member shall enjoy privileges in accordance with his/her respective tier and category of membership in all Best Mart 360° and FoodVille retail outlets in Hong Kong and Macau.
3.2 For details of membership privileges, offers and benefits for each tier of membership (including Fans, Members (Physical membership card and E-card holders) and Gold Card Members), please refer to https://www.bestmart360.com/member
3.3 Birthday benefits (applicable to Members (E-card holders) and Gold Card Members only):
(i) Both Members (E-card holders) and Gold Card Members can enjoy birthday benefits. Such members entitled to these benefits shall collect and redeem E-coupons through the E-card.
(ii) All Members must fill in the correct birthday month during the registration of E-card. No changes can be made once inputted.
(iii) Each member can only enjoy the birthday benefits once in a year.
3.4 Member Reward Points shall be separately accumulated by the location where the relevant purchase is made:
Member Reward Points (applicable to all Members and Gold Card Members)
(i) Any net purchase in HKD1 in Hong Kong retail outlets will be entitled to 1 point in Hong Kong, which can be redeemed by member for HKD10 discount with every 1,000 points and so on. (hereinafter referred to as “Hong Kong Member Reward Points”)
(ii) Any net purchase in MOP1 in Macau retail outlets will be entitled to 1 point in Macau. which can be redeemed by member for MOP10 discount with every 1,000 points and so on. (hereinafter referred to as “Macau Member Reward Points”)
3.5 The Member Reward Points accrued in Hong Kong or Macau are only applicable to the retail outlets in the subject region which cannot be used for cross-region purpose. Member’s purchase amount shall be calculated and recorded separately according to the region (i.e. Hong Kong or Macau) for which the purchase was made. The Member Reward Points earned shall also be calculated and recorded separately according to the region (i.e. Hong Kong or Macau) for which the purchase was made. For example: Hong Kong Member Reward Points may only be used in Hong Kong retail outlets; Macau Member Reward Points may only be used in Macau retail outlets.
3.6 The Hong Kong or Macau Member Reward Points can only be redeemed as cash discount in the relevant region for purchases made in our Best Mart 360° or FoodVille retail outlets in Hong Kong region or Macau region respectively.
3.7 Reward Point(s) earned through purchase will be displayed in the member’s account in 30 minutes after the transaction. The reward point records in the electronic membership card can only show the latest 20 entries in the current year.
3.8 Member Reward Point(s) earned shall remain valid from 1 January (0:00) to 31 December (23:59) of the same year, and Reward Points that remained unredeemed shall expire immediately afterwards (“Expiry Date”). All Reward Points must be used before the Expiry Date. Any unused Reward Points cannot be accumulated. All expired Member Reward Points shall be invalid and serve no further purpose.
4. Enquiry / Update / Lost Reporting of Membership Card
4.1 A member who has lost his/her physical membership card will not receive a new physical card for replacement. Once the relevant personal information of such member has been verified, we will send a registration invoice for the same membership tier (which is valid for 60 days from the date of issue, inclusive of the issue date), together with his/her physical card number (Card back ID), to such member. Such member may register as a E-card member through the Best Mart 360 Mobile App downloaded and installed in his/her smart mobile phone, by selecting “First time login for APP & Physical Card Member” in the interface of “Member Zone”, and then select “Physical Card (Not yet registered in APP before)”. Afterwards, by inputting the Physical Card Number (Card Back ID), Invoice Number and Store Code as shown on the registration invoice, and inputting simple personal information and setting password, such member will then be registered for the E-card and will continue to enjoy the benefits and privileges in the same membership as before.
4.2 For any updates or changes of personal Relevant Information, a member may log into the Best Mart 360 Mobile App for such updates or changes, or such member may send an email to [email protected] or call us at +852 3916 1888 for enquiry.
4.3 For any membership account termination, a member should send an email to [email protected] or call us at +852 3916-1888 or log into the Best Mart 360 Mobile App. Once his/her relevant personal information is verified, his/her membership account shall be terminated in 14 working days and his/her accumulated points/ eStamp, eCoupon and earned/uncollected benefits will be cancelled entirely. Your personal information will be removed, and member will be unable to log into Best Mart 360 Mobile App. If a member’s membership were terminated by us for any reason(s), his/her accumulated points shall also be cancelled immediately.
5. Others
5.1 We shall have the absolute discretion to refuse the application by any applicant, suspend or terminate the membership of any members without reasons or prior notice. In the event a membership is terminated by us for any reason(s), all reward points will also be cancelled immediately.
5.2 Membership Card, membership and rewards are strictly non-transferable under any circumstances. If we suspect such membership, membership card, member privileges or reward points were obtained by fraudulent, dishonest means or in such a manner not in accordance with the Terms and Conditions herein, we shall be entitled to terminate or suspend such membership, such accumulated reward points and the membership privileges without any prior notice and compensation.
5.3 We shall not be responsible for any unauthorized use of any Membership Card and reserve the rights to deduct reward points from any member account without any compensation.
5.4 A member must present his/her Membership Card upon payment to enjoy points accumulation or using members’ privileges. The entire single transaction can only be recorded in one membership account. Under no circumstances may transaction(s) be recorded after payment.
5.5 A member is not entitled to enjoy or to reinstate any membership privileges and benefits for CLUB 360° if he/she is unable to present a valid physical membership card or electronic membership card on the payment of purchase.
5.6 CLUB 360° Membership privileges cannot be used in conjunction with privileges carried by our staff membership card, our VIP card or any other joint promotions.
5.7 Any request for services relating to CLUB 360° must be raised by the registered member only. (We shall not accept and handle requests by any non-member.)
5.8 All data and information in relation to CLUB 360° member accounts shall be based on our computer system record.
5.9 We shall not be liable for any loss caused and occasioned by technical problem that prevents us from retrieving membership information from our computer systems.
5.10 The WeChat Mini Program is a third-party operating platform. We are not responsible for the stability, reliability, and security of platform operation. We are not responsible for any technical or security issues on the WeChat Mini Program arising from member registration, platform information or while using the membership and its benefits.
5.11 We shall have the right to review membership tiers and eligibility criteria for specific membership from time to time or reassign other memberships to members based on our decision without prior notice.
5.12 We reserve the absolute right to change the Terms and Conditions herein and terminate CLUB 360° scheme at our sole discretion without any prior notice.
5.13 The applicant hereby confirms that he/she has read, understood and agreed to the Terms and Conditions of Membership Card and the “Personal Information Collection Statement”.
5.14 In addition, a member also agrees that, in accordance with the “Personal Information Collection Statement” we shall be entitled to collect, retain, store, transfer and utilize the Relevant Information relating to his/her purchase and the name, gender, phone number, email address, month of birth, age range and residential district as provided to us by the members. A member is entitled to access the Relevant Information previously provided to us and if it is inaccurate be allowed to make correction(s). We reserve the rights to charge a nominal fee for such operations.
5.15 This document has English and Chinese versions. Should there be any discrepancy between the English and Chinese versions, the Chinese version shall prevail.
In cases of any disputes arising from the implementation or interpretation of the membership Terms and Conditions, our Company reserves the rights of final interpretation and decision.

3. Prevailing language

4.1 The Terms and Conditions of Use shall be governed by the laws of the Hong Kong SAR and the parties herein agree to submit to the exclusive jurisdiction of the Hong Kong courts for determining any disputes arising from or in relation to these Terms and Conditions of Use.

· If our product is not in good condition, customer can exchange/refund after the verification (exclude selected items). Please visit our stores with Frozen / Chilled products for any related exchange. Kindly note that only one exchange/return request can be made per each order.
· 7 Days Product Quality Guarantee applies to all retail stores in Hong Kong and Macau, services must be based on the shopping district. For example, products purchased in Hong Kong stores must be exchanged/refunded at any store located in Hong Kong, could not cross-district.
· Exchange/Refund is only available when product with original packaging and valid original receipt are provided. Blacked out or faded receipt will not be accepted. Cash will be refunded for purchases made with Cash or Octopus card. For credit card payments, refund service is only eligible to the original credit card, and original credit card and receipt are needed to be presented for processing refund. For electronic payment method (such as Apple Pay/Google Pay/BoC pay/Samsung Pay/WeChatPay/Alipay/UnionPay etc), the original used mobile with the relevant electronic transaction record is also needed to be presented. Except the Cash and Octopus card payment, it will take 4-6 weeks to refund to your original account with the same method as the original payment. For the transaction of Macau Pass and MPay: cash will be refunded for MOP 500 or below and will take 4-6 weeks to refund for MOP 500 above.
· Any exchange /refund will be rejected after 7 calendar days purchase.
· In case of product refund, the Member Reward Points (‘Points’) granted from that transaction will be deducted from and adjusted in member account. The relevant redeemed Points (converting as cash discount/purchasing product) of refunded product will be adjusted in member account by our system calculation (credited back on the redeemed Points and/or deducted from the granted Points).
· For any product exchange/refund, all related free gifts and coupons are needed to be returned.
· If exchange for other products, customer need to pay the difference in selling price. The difference will not be refunded if the price of the exchange product is lower than the original one. The exchanged product is not entitled to return/refund.
· For any product refund, the discount amount (calculate in pro-rata basis) will be net off from the refunded amount for any transaction with discount coupon used. No coupon will be re-issued. Price quoted is in the local currency. Example: Product A – sold at $100; Product B – sold at $ 25. Total invoice amount $125. $5 discount coupon can be used for any transaction upon $120. Actual amount paid: $125-$5=$120.
· Product B need to refund. Coupon discount proportion: $5x($25/$125)=$1
· For any transaction with BEST MART 360 Gift Voucher used, no refund is allowed.
· In case of any disputes, CIAO INTERNATIONAL LIMITED and BEST MART360 MACAU LIMITED reserves the right for final decision.
